ARTICLE 1 | DEFINITIONS
In these terms and conditions the following capitalised terms have the meanings set out below:
1) AJR NEXUS LTD – a company registered in England & Wales under number 16399836, whose registered office is 483 Green Lanes, London, N13 4BS, United Kingdom.
2) AJR NEXUS LTD is the party using these terms and conditions.
3) User – Any natural or legal person who has concluded, or intends to conclude, a Usage Agreement with Rentfinder.ie, as well as every visitor to the Website.
4) Consumer – A User who is a natural person acting outside the scope of a business or profession.
5) Usage Agreement – The agreement between Rentfinder.ie and the User that is, or will be, formed by registering on the Website and under which the User may, with or without payment, make use of the Web Space.
6) Membership – A Usage Agreement under which the User has a payment obligation towards Rentfinder.ie.
7) Website – The website Rentfinder.ie
8) Profile / Web Space – The section of the Website accessible exclusively to the User via his/her login details.
9) Content – All data—including photographs, videos and texts—uploaded by the User via the Profile and/or published on the Website and/or shared with other Users.
ARTICLE 2 | GENERAL PROVISIONS
1) These terms apply to every visit to and use of the Website, to every offer by Rentfinder.ie to enter into a Usage Agreement, and to every resulting Usage Agreement.
2) If Rentfinder.ie does not always insist on strict compliance, this shall not constitute a waiver of its right to insist on strict compliance in future.
3) Should any provision of these terms or of the Usage Agreement be void or voided, the remaining provisions shall remain in full force. The parties will then consult to agree a replacement clause that reflects the purpose and intent of the original as closely as possible.
ARTICLE 3 | OFFER AND CONCLUSION OF USAGE AGREEMENTS
1) Every offer by Rentfinder.ie to enter into a Usage Agreement is without obligation; it is never obliged to accept a registration.
2) The User may not derive rights from any offer that contains an obvious error or mistake.
3) A Profile is created by the User’s registration on the Website and may not be made in another person’s name. Rentfinder.ie reserves the right to delete such Profiles immediately.
4) The Usage Agreement is formed once Rentfinder.ie confirms the User’s registration by e-mail and the User has met all conditions stated in the offer.
ARTICLE 4 | RULES OF USE AND RESTRICTIONS
1) The User warrants that all data provided on registration are correct, accurate, up to date and complete.
2) The User is solely responsible for communications with other users; Rentfinder.ie accepts no liability in that respect.
3) Uploading, sharing or publishing unlawful, misleading, violent, infringing, hateful or discriminatory Content is prohibited.
4) The Website may not be used for unlawful acts or criminal behaviour, including infringements of intellectual-property rights, distribution of confidential data, racist content or criminal data traffic.
5) The User is liable for all activity via the Profile and must keep login details confidential.
6) Harvesting or using other Users’ login data is forbidden.
7) Defamation, threats, bullying, stalking or intimidation—whether in private messages or otherwise—is prohibited.
8) Infringing other users’ privacy or disclosing their personal information to third parties is prohibited.
9) Hindering or disrupting the Website, servers or networks (e.g. via malware) is prohibited.
10) The Website may be used only for its intended purposes; collecting profile data for improper ends is forbidden.
11) Users communicate with others at their own risk and indemnify Rentfinder.ie against claims arising from other users’ conduct.
12) Rentfinder.ie is not responsible for Content uploaded or shared via the Web Space; use is entirely at the User’s own risk.
13) Providers of accommodation decide for themselves whether—and to whom—they rent; there is no lottery or priority for those who respond first.
14) Rentfinder.ie may, but need not, remove, block or monitor Content that breaches these terms. Complaints found to be valid can lead to Content being removed without liability.
15) The User warrants ownership of, or lawful authority over, all Content posted, and may not post images of others without their consent.
16) Rentfinder.ie cannot permanently monitor all Content. Suspected breaches can be reported; Rentfinder.ie will act within its capabilities to prevent recurrence and may remove Content if necessary.
ARTICLE 5 | SPECIAL PROVISIONS FOR USERS OFFERING ACCOMMODATION
1) Accommodation may be advertised free of charge, but all mandatory details must be supplied.
2) Ads must be removed promptly once the property is let or otherwise unavailable.
3) Ads may also be placed on other marketplaces and shared via Facebook and Trovit.
4) Providers are requested to respond within a reasonable time to enquiries, even if the property is already let or they are not interested.
ARTICLE 6 | REFUSAL, BLOCKING AND REMOVAL OF PROFILES AND CONTENT
Rentfinder.ie may refuse, block or remove a Profile or Content that:
a) contains unlawful or criminal material;
b) is violent;
c) is discriminatory on grounds of race, gender, politics, religion or belief;
d) contains malware/viruses or links thereto; or
e) breaches any provision of these terms.
Blocked or removed Profiles, or agreements terminated for reasons attributable to the User, do not entitle the User to any refund.
ARTICLE 7 | TERM, TRIAL PERIOD, RENEWAL AND TERMINATION
1) A paid Membership is a subscription agreement.
2) If a trial offer is selected, the Membership begins immediately when the order is completed and Premium access is activated.
3) The trial period is time based. It runs for seven consecutive periods of 24 hours, being 168 hours in total, from the exact time Premium access is activated.
4) The trial period does not run by calendar date or by whole calendar day. It ends exactly 168 hours after Premium access is activated.
5) For example, if Premium access is activated on 11 February at 15:25, the trial period ends on 18 February at 15:25.
6) To avoid the renewal charge, the User must submit a cancellation request before the exact time the trial period ends.
7) Unless the User cancels before the exact time the trial period ends, the Membership automatically renews at the standard subscription price and continues on a recurring 28 day basis until cancelled.
8) The User may cancel at any time via the User account, by emailing info@rentfinder.ie, or by contacting customer support through the Website.
9) For cancellation requests sent by email, the time of receipt by Rentfinder.ie’s email system is treated as the time the cancellation request was submitted.
10) If the User cancels before the exact time the trial period ends, no renewal charge will be applied.
11) If the User cancels after the trial period has ended or after a renewal has taken place, the cancellation will stop future renewals only. The current billing period remains active until the end of that billing period, and the charge for that billing period remains payable.
12) A failed payment, reversed payment, chargeback, expired payment method, or administrative cancellation following non payment does not constitute a valid cancellation request for a billing period that has already started.
13) Where Rentfinder.ie administratively cancels a Membership after a failed or reversed payment, this is done only to prevent future renewals or further charges. Any amount due for a billing period that has already started remains payable.
ARTICLE 8 | PRICES AND PAYMENTS
1) The price of the Membership is stated on the Website at the time of ordering.
2) Where a trial offer is available, the trial price covers the first 168 hours of Premium access from the exact time Premium access is activated.
3) Unless the User cancels before the exact time the 168 hour trial period ends, the Membership automatically renews at 39 euros every 28 days.
4) By placing an order and selecting a payment method, the User authorises Rentfinder.ie to collect the trial payment and, unless cancelled in time, each recurring subscription payment thereafter using the selected payment method.
5) If a payment is declined, reversed, charged back, or otherwise not successfully completed, the outstanding amount for the relevant billing period remains due and payable.
6) If a renewal payment fails after a new billing period has started, Rentfinder.ie may suspend or cancel future access and future renewals, but this does not affect the User’s obligation to pay for that billing period.
7) All invoice amounts must be paid within the stated payment term.
8) If the User fails to pay on time, the User is automatically in default and Rentfinder.ie may recover the outstanding amount together with any reasonable administrative, collection, legal, and enforcement costs permitted by law.
9) In the event of an unjustified or fraudulent chargeback, the User is liable for the disputed transaction amount, any payment provider fees, VAT where applicable, and any reasonable third party recovery costs incurred by Rentfinder.ie.
By continuing to use our service, you agree to bear these costs should such a chargeback occur.
All chargeback related costs are invoiced in euros. Amounts deducted in another currency are converted to euros using the publicly available Google exchange rate on the date of deduction.
Where the disputed payment relates to a subscription, the subscription will be invoiced at the standard price of 39.00 EUR VAT included, with the corresponding net and VAT amounts shown for accounting purposes.
The User is also responsible for any additional reasonable costs incurred to recover the debt, including third party collection and legal fees.
ARTICLE 9 | LIABILITY AND INDEMNITY
1) Rentfinder.ie merely provides a search engine / noticeboard and is not involved in Users’ communications or any agreements they reach; it accepts no liability in that regard.
2) Users, not Rentfinder.ie, decide what Content is uploaded; Rentfinder.ie is not obliged to check its legality or accuracy and is not liable for it. Users indemnify Rentfinder.ie against claims alleging that such Content is unlawful, inaccurate, incomplete or misleading.
3) Rentfinder.ie is not a letting agent and is not a party to tenancy negotiations or contracts; it is not liable if Users fail to find tenants or properties.
4) Rentfinder.ie does not verify the accuracy or completeness of property listings; providers are solely responsible and indemnify Rentfinder.ie against claims by other Users.
5) It is never liable for damage resulting from unauthorised use of a User’s login details.
6) While Rentfinder.ie endeavours to keep the Website available, uninterrupted availability cannot be guaranteed; liability is excluded.
7) It may take the Website offline for maintenance or other reasons; liability is excluded.
8) Except in cases of intent or deliberate recklessness, Rentfinder.ie is not liable for programming errors, viruses or harmful components, nor for third-party websites linked via the Website.
9) Rentfinder.ie secures its systems against misuse but is not liable for third-party infringements of Users’ rights.
10) Any liability to a paying User is limited to the amount paid for the Membership (or the relevant part thereof).
11) Users are liable for all damage caused by breaches of these terms, including spreading malware or disrupting the Website, and for all related costs incurred by Rentfinder.ie.
12) Users who breach these terms or the law indemnify Rentfinder.ie against resulting damages and third-party claims.
ARTICLE 10 | INTELLECTUAL PROPERTY / COPYRIGHT
All intellectual-property rights in the domain name, Web Space, Website and their components—including the name “Rentfinder.ie”, design, operation, images and sounds—belong to Rentfinder.ie (unless owned by Users or third parties). Users may not reproduce, alter, distribute, exploit or create derivative works from such material except as required for normal use of the Web Space/Website.
ARTICLE 11 | FINAL PROVISIONS
1) Irish law exclusively governs the Usage Agreement and all other legal relationships between the User and Rentfinder.ie.
2) Before going to court, the parties must make every effort to resolve disputes amicably. Complaints must be e-mailed to Rentfinder.ie within a reasonable time, fully and clearly described.
3) Complaints are answered within 14 days; if more time is needed, an acknowledgement and timeframe for a full response will be provided within that period.
4) If these terms are available in several languages, the English version prevails for interpretation.
